CCC or Certificate of Completion and Compliance in Malaysia

 

The CCC is a legal requirement of the Street, Drainage and Building Act 1974 in Malaysia. This means that no occupation of the building is allowed until the CCC has been obtained.

 

What is the meaning of CCC?

 

The CCC, stands for Certificate of Completion and Compliance, is a document that confirms a building has been constructed according to the approved plans and meets all necessary safety and regulatory standards.

In Malaysia, obtaining a Certificate of Completion and Compliance is mandatory for all buildings—residential, commercial, or industrial—before they can be occupied. This certificate assures that the building is safe for use.

 

Certificate of Completion and Compliance (CCC) vs Certificate of Fitness (CFO)

 

The Certificate of Fitness for Occupation (CFO), issued by local authorities (pihak berkuasa tempatan or PBT) under the Uniform Building By-Laws, allows developers to hand over vacant possession of buildings once a confirmation letter is received.

 

In 2007, the Certificate of Completion and Compliance (CCC) was introduced to streamline the building process, replacing the CFO.

 

The CCC, issued by the Principal Submitting Person (PSP), addresses issues such as delays, non-compliance, and processing challenges associated with the CFO, allowing buyers to move into their properties more efficiently.

Who issues CCC in Malaysia?

 

The PSP is the qualified expert who submits building plans to the local authority for approval. It can be a team of professional architects, professional engineers, or building draughtsmen registered with the Board of Architects Malaysia or the Board of Engineers Malaysia.

 

CCC Process and Checklist

 

The PSP will make sure the building has duly met all technical conditions imposed by local authorities and agencies. The CCC system employs a stage certification process (from Form G1 to G21) which covers every aspect of the building component, including:
 

  • Foundations
     
  • Earthworks
     
  • Plumbing
     
  • Drainage
     
  • Street Lighting
     
  • Landscaping
     
  • Fire Safety

 

It's important to understand that the CCC is only issued by local authorities after approvals from 6 government departments for the essential services have been secured, including:
 

  1. Confirmation of electrical supply from TNB.
     
  2. Confirmation of water supply from SYABAS.
     
  3. Connection to sewage treatment plants or mains by the Jabatan Perkhidmatan Pembentungan.
     
  4. Connection to roads and drainage by the local government.
     
  5. Clearances for active fire fighting systems from the Bomba (Fire and Rescue Department).
     
  6. Clearances for lifts or machineries from the Jabatan Keselamatan dan Kesihatan Pekerjaan.

 

Legal Consequences for Non-Compliance

 

The information above highlights that local authorities have strict requirements before a CCC can be issued, ensuring that a building is deemed safe for occupancy. Without proper guidelines for issuing the CCC, the penalties can be severe.


Prospective tenants should be aware that occupying a building before a CCC is issued, or applying for business registration without one, is considered an offence.


Violating Section 127 can lead to a RM10,000 fine, with an additional RM500 for each day of non-compliance post-conviction. For offences linked to the issuance of the CCC, Section 70(27), fines may reach RM250,000 or up to ten years in prison.

 

Partial Certificate of Completion and Compliance

 

The Partial CCC in Form F1 allows specific sections of construction projects, like an industrial complex with cooling towers, to be completed and approved ahead of the entire development.


Building plans must clearly indicate these sections, and additional requirements may be imposed by local authorities, such as infrastructure protections.
